Central City Council Meeting

The City of Central held its regular City Council meeting on Tuesday, May 19th, at City Hall. Mayor Ron Slinger conducted the meeting attended by council members Ron Engels, Bob Spain, and Tom Reilly. Alderman Bob Giancola was not present.Consent Agenda

The Council quickly approved the consent agenda. It included a listing of the bills paid on May 7th and May 12th; the City Council minutes from May 5th; the April 2009 financial report; and the Historic Preservation Commission minutes from March 11th.

Public Forum

Terry Ballowe presented his case to the council for “cleaning up” his parcels of land by turning his mining claims into three subdivided lots. The property contains unrecorded easements and right-of-ways which compounds issues with the land. Ballowe is willing to donate part of the property to Central City if the land issues are resolved to the satisfaction of the city.

Public Hearings

Gloria Gaines was the next speaker before the Council and she stated her concerns regarding the length of time special events signs would be displayed. Gaines pointed out the value of the historic preservation of Central City and did not want to see the City continuously cluttered with signs if the 180 day allowance were permitted. Gaines requested that a total of 90 days be allowed per sign.

After the public hearing, the Council unanimously passed Ordinance 09-07 amending the sign code for Special Event Signage. The amended code reads in part, “Special events signs shall be posted for a period of not more than ninety (90) consecutive days as approved by the City, subject to no more than two (2) requests in any calendar year.”

There was no public comment regarding Ordinance 09-08, which amends Section 6-202 of the City of Central Municipal Code Concerning Liquor License Fees and Related Fees. Mayor Slinger commented that the State of Colorado actually sets the fees. The Council unanimously passed the ordinance.

Unfinished Business

The next item on the agenda, Erosion Mitigation Plan/Prospectors Run, was tabled until the next Council meeting on June 2nd.

BBC Research & Consulting of Denver provided a Central City Impact Fee Proposal at a cost of $18,000 for a study of evaluating issues specific to Central City’s economic base. Impact fees are one-time charges usually assessed for new development at the time of issuing a building permit. The proposal was unanimously approved by the Council.

New Business

The First Amendment to Primary Fire Protection Service Agreement with Clear Creek County was also unanimously passed. Mayor Slinger provided some background to the public audience in that the city contracted to pay an annual fee of $17,342 for the service, primarily on the Central City Parkway. Only 11 calls were responded to by the service in the years 2007-08 and the city decided to terminate the contract. Rather than terminate the contract, Clear Creek Fire Authority waived the fees in agreeing to continue the service. The Council considered it was a very good agreement.

After a short discussion, the Council unanimously passed a Policy Memorandum regarding the City’s Access Channel (Channel 20). The policy covers the programming and operation of the Access Channel, which provides information to the public concerning the City’s governmental related operations. Mayor Slinger suggested compiling a hand-out for new businesses in town that would state the policy, which doesn’t allow any advertizing on the channel.

The final topic was the Eighth Amendment to City Manager’s Employment Contract. The Council passed it unanimously and congratulated the City Manager, Lynnette Hailey, who would be back for another year.

Reports and Executive Session

City Manager Lynnette Hailey covered details of the next CML conference. Hailey mentioned the Confidential Legal Opinion on Mack Road and Confidential Legal Agreement on the Burg Simpson litigation to the Council. Mayor Slinger adjourned the meeting and the Council recessed before beginning an executive session to discuss the Ballowe property trade.

The next meeting is scheduled for Tuesday, June 2nd, at 7:00 pm in City Hall, 141 Nevada Street in Central City.
