Clark elected to Central City Council Lisa Kunz 06/05/2008 - The May 27, 2008 meeting was called to order by Mayor Buddy Schmalz. Present were Alderman Ron Engles, Chip Wiman and Bob Spain. City Clerk Wendy Hefner swore in the newest City Council member, Tralece Clark. No Conflicts of Interest were presented. The Consent Agenda was approved and included the regular bill lists for May, the minutes of May 6, 2008 and the April financial reports. Public Forum Barbara Thielemann represented the Hidee Gold Mine, located above Central City. Ms. Thielemann invited the alderman (and woman), along with the public to the 4th Annual End of Spring Celebration on June 20th from 4-7pm. Food, drink and entertainment are all free. In favor of the agreement between Black Hawk and Central City to improve the park situated above Central City was Gloria Gaines. Mrs. Gaines asked if a stop of the Gilpin Connector may be an option. City Manager Lynette Hailey explained that she is a member of the Board for the Black Hawk Transportation Authority and as such, she explained that the Gilpin Connector is contracted through BHTA by the county. If a stop were to be added, Mrs. Gaines would have to direct her request to the County Commissioners. City Manager Hailey further added that the Connector stops only at paved stops so since the park is on an unpaved road, the liability of such a stop would need to be addressed. Action Items Second Amendment to the Subdivision Improvement Agreement with Prospector’s Run. The proposed amendment is an agreement between the City and the Owner/Developer to amend certain provisions. Namely, the security for the construction of phase two of public improvements ($50,000), the security amount of ten percent for public improvements of phases three and four. Also, no residential building permits will be issued until the public improvements for phases two, three and four are completed. The impact fees shall remain at $2,557 per unit and the City agrees to hold the water tap fee at $10,000 for five years. The Amendment passed. Intergovernmental Agreement with Black Hawk for 2008 Capital Improvements and future maintenance costs for William Russell Park. This agreement calls for Black Hawk to pay $6,700 to Central City, to be used for the purchase and installation of equipment for the park. Central City will agree to have said equipment installed within 90 days of receipt of the funds. Black Hawk also agreed to contribute $850 per year toward the yearly maintenance of the park. The Agreement was approved. RESOLUTION 08-08 A Resolution conditionally approving an access permit for the Goltra Property. This Resolution has very specific conditions that must be met prior to work beginning, during construction and limitations to the amount and types of uses once the road is completed. The new access would allow up to ten vehicles per day to access the property. When the property is completed, the owner can readdress the restrictions. Resolution 08-08 was approved. Public Hearing Rita Lee spoke as a representative of Prospector’s Run. Ms. Lee asked the Council how the monies that Prospector’s Run had paid in impact fees were disbursed. She had specific questions regarding specific amounts that she felt should have been disbursed directly to the fire or police departments. City Manager Hailey advised Ms. Lee that the monies were spent in such a way as to benefit the police and/or fire departments indirectly. City Manager Hailey explained that the Council does not know the answers to the detailed questions asked by Ms. Lee. Hailey offered to send Ms. Lee the documents necessary to answer the questions specific to the impact fees paid. Mayor Schmalz offered a thank you to Ms. Lee for asking the detailed questions and noted that when these kinds of questions are asked, it brings to light the subject and accordingly, the Council is made aware of ways the public looks at some of the finer points of running the city. The discussion ended amiably. Council further assured the public that the impact fees will be monitored closely during the next budgeting sessions. The next meeting is scheduled for June 10, at 7:00 p.m.
